These Terms of Service ("Terms") govern your access to and use of the EasyAI website at easyai.au, the EasyAI platform at easyaiaus.space, and related services (collectively, the "Services") provided by EasyAI ("we", "us", or "our"). By accessing or using the Services, you agree to these Terms.
1. Acceptance of terms
If you do not agree to these Terms and our Privacy Policy, you must not use the Services. If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Description of services
EasyAI provides an AI-powered growth workspace that may include SEO tools, content creation, outreach, advertising support, market research, CRM features, AI agents, human expert support, and integrations with third-party platforms including social media channels.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You must provide accurate registration information and keep your account details up to date.
4. Account registration and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at dinali@easyai.au if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms or pose a security risk.
5. Acceptable use
You agree not to:
- use the Services for unlawful, harmful, fraudulent, or misleading purposes;
- violate any applicable law, regulation, or third-party rights (including intellectual property and privacy rights);
- upload malware, spam, or content that is abusive, defamatory, or discriminatory;
- attempt to gain unauthorised access to systems, accounts, or data;
- reverse engineer, scrape, or interfere with the proper operation of the Services;
- use the Services to generate or distribute content that violates platform policies of connected social networks or ad platforms;
- resell or sublicense the Services except as expressly permitted by us in writing.
6. Subscriptions, fees, and payments
Some features are free; others require a paid subscription or service package. Prices, billing cycles, and plan limits are shown at checkout or in your account. Fees are generally non-refundable except where required by law or stated in a specific agreement. We may change pricing with reasonable notice for future billing periods.
7. AI-generated content
EasyAI uses artificial intelligence to assist with content and workflows. AI outputs may be inaccurate, incomplete, or inappropriate for your use case. You are solely responsible for reviewing, editing, and approving any content before publishing or using it commercially. We do not guarantee rankings, leads, revenue, or specific business outcomes.
8. Your content and data
You retain ownership of content and data you submit to the Services. You grant us a limited licence to host, process, display, and use that content solely to provide and improve the Services, support integrations you authorise, and comply with law. You represent that you have the rights needed to submit such content.
9. Intellectual property
The Services, including software, branding, design, and documentation, are owned by EasyAI or its licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary materials except as needed to use the Services.
10. Third-party services and integrations
The Services may integrate with third-party tools and social platforms. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services, outages, or policy enforcement actions taken by external platforms.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the fullest extent permitted by law, EasyAI and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of AUD $100 or the amount you paid us in the 12 months before the event giving rise to the claim, except where liability cannot be excluded under applicable law.
13. Indemnification
You agree to indemnify and hold harmless EasyAI from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, your breach of these Terms, or your violation of any law or third-party rights.
14. Suspension and termination
We may suspend or terminate your access to the Services at any time if you breach these Terms, create risk for us or other users, or where required by law. You may stop using the Services at any time. Provisions that by their nature should survive termination will continue to apply.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales, subject to any non-excludable consumer rights in your jurisdiction.
16. Changes to these terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms. Material changes may also be communicated through the platform or by email.
